Defendant ordered to pay $489,000 in default judgment.
Bungie is parading around its latest win this week. The company recently sued a user by the name of Jesse James Comer of West Virginia. The complaint alleged that Comer repeatedly harassed a black Destiny 2 creator as well as his wife with racist calls and threats of violence, as well as harassing acts like ordering Dominos and sending it to the victim’s house.
The lawsuit notes that Bungie hired investigators as well as protection for the couple Comer was harassing at their own expense.
Bungie was forced to take expensive measures to protect the Does from the threat posed by Comer (who at that point remained unknown and anonymous). Bungie sent out executive protection within an hour of the “pizza attack” and notified the local police department. Bungie then engaged investigators and outside counsel to identify and locate who was threatening its employees. Bungie had to engage counsel in Canada and obtain a Canadian court order to ascertain Comer’s identity. Once Bungie identified who was threatening its employees, it had to retain additional investigators and counsel in West Virginia, where Comer lived, to obtain a restraining order. All of these measures had to be taken in a matter of days, adding to the cost. Bungie also retained round-the-clock security for the Does.
The defendant Comer decided to respond by…not responding, and as a result the court entered a default judgment in favor of the plaintiff. Whether or not Comer will actually pay up and whether this judgment is enough to stop him from harassing black people is another story.
