Both companies avoid jury trial.
The Epic lawsuit against Apple is going to trial in May of 2021 and both companies have been successful in their attempts at avoiding a jury trial. Why? Well it’s a lot easier to present your case to the judge than try to sway a jury or more likely to find a jury who haven’t been affected by Epic’s massive media campaign.
According to schedule filings presented this week Epic’s antitrust lawsuit will go to trial on May 3, 2021. The trial will be a bench trial meaning the only people they’ll have to convince is the judge. The length of the trial is up in the air.
Epic launched a lawsuit and media campaign against Apple after pushing direct pay on the mobile versions of Fortnite causing Apple to retaliate and ban the game from the store for violating contract agreements. Epic has been pushing for the public to take its side via commercials, in-game events, and other promotional campaigns, and is suing Apple on grounds that the closed environment of their devices constitutes an illegal monopoly. Epic has so far failed in its attempts to convince the judge to temporarily reinstate Fortnite to the store while the lawsuit continues.
