NCSoft Still Intends To Use City of Heroes

When? How? Where? Nobody knows.

Today’s news is a follow up from January’s article about City of Heroes. As we all know City of Heroes died nearly nine years ago and over the last couple of years major private servers have cropped up to replace the experience. While NCSoft owns the copyright on City of Heroes and will for decades to come, they lost the trademark years ago due to lack of continued use.

But NCSoft filed a new trademark registration, and this month filed yet another extension on its use. According to their filing attorney, the City of Heroes trademark is in the research or development phase, and the company has existing intentions on using the trademark in commerce.

The latest extension kicks the ball down the court another six months, presumably at which point NCSoft will file yet another extension. After that? Probably another six month extension. We’ve speculated before that this is part of NCSoft negotiating something official with the City of Heroes rogue servers because they could theoretically charge $1 in licensing and it would allow them to retain the City of Heroes trademark.
