Dark and Darker posted a small W this week. No, the lawsuit is not over. Not by a longshot. However the folks over at Ironmace announced an update in the court case that might prompt opening up some cheap champagne or perhaps a bottle of sparkling apple juice.

Apparently Nexon’s preliminary injunction has been dismissed, potentially allowing the game to return to Steam where it was struck with a DMCA takedown last March. The game has since been buyable on Ironmace’s own website, and we learned that Krafton had gotten involved to develop a mobile version of the title.

Yesterday, Nexon’s preliminary injunction against Iron Mace for trade secret and copyright infringement was dismissed.

The court ruled that “Iron Mace’s game cannot be viewed as infringing on Nexon’s copyright or trade secrets,” thus rejecting the claims and suspicions that Dark & Darker was developed by using Nexon’s trade secrets and infringing on its copyrights. It wasn’t. In addition, the court ruled that Dark & Darker’s service should not be suspended based on Nexon’s claims and evidence alone.

Gamers immediately hit back against Nexon by review bombing multiple titles on Steam. Nexon filed lawsuit in the United States and Korea claiming that Dark and Darker infringes on the copyright for its abandoned title Project P3.
