Desert Dragon World Boss Comes To Black Desert PS4


Black Desert has a new world boss on PS4 in the form of Nouver. Pearl Abyss released the new boss earlier this week along with a new world boss timetable. World bosses spawn across all worlds simultaneously and share their HP across all servers. Nouver drops a sub-weapon box that contains powerful items allowing players to maximize their AP.

“Nouver is a force of nature that rules over the Desert. Adventurers who attempt to face the behemoth dragon will have to fend off sandstorms, heatstroke and hypothermia to just get to the dragon. Then when you get there, you need to face the beast itself! But with great risks come great rewards, and it is possible to get a mighty item from Nouver.”

Playstation Credit Card: New Arbitration Rules, Late Fees, and Your Personal Info


Do you have a Playstation credit card? Keep reading.

Those of you who have Playstation credit cards will be getting an email shortly that you will most likely throw out because it says “important information about changes to your Playstation Card Account” and who ever pays attention to that boring garbage? Thankfully you have me, budding lawyer, to read the boring documents for you. You might also have opened the mail because it was sent by Comenity Bank, and they have nothing to do with the Playstation credit card. Well they didn’t anyway.

Comenity Bank is taking over Playstation’s credit card from Capital One, maybe because of that massive data breach. This all goes into effect in November 2019. Comenity is a brand under Alliance Data Card Services and used to be known as World Financial Capital Bank and World Financial Network [National] Bank. You may remember them because in 2011 company executives were called in to testify to Congress about a data breach.

So what does this change mean for you, you savvy handsome consumer? Well it means that your Capital One card is going away as of November 9 when it will be shut off and fully replaced with the new Playstation card. It also means that your Capital One Premium Access is going away. You will of course need to update your automatic payments as your new card will have different numbers and expiration dates. Paperless billing will need to be reset.

Those of you worried that you might need to sue Comenity Bank at some point in the future should be aware that while Capital One did not have forced arbitration, Comenity Bank absolutely does. Comenity won’t demand arbitration for small claims court lawsuits. Thankfully you have the right to reject the arbitration provision. Unfortunately it isn’t as easy as logging in and clicking a button. Thankfully it’s a lot easier than you may think. You don’t even need to consult an attorney.

Important to note is that you must sign the paper otherwise it is not binding. If there are multiple people on the card, they must all sign. It must also be sent within 30 calendar days after you receive notice that you have a right to reject the arbitration provision. In other words, when you receive this letter you probably threw out. So why would you opt to arbitrate instead? Wellllllllll Comenity does have a provision that any arbitration hearing must take place in a location reasonably convenient to you. Comenity will also pay any and all fees of the arbitration including the arbitrator, reasonable attorneys fees and expert fees if you prevail, if it is required to enforce the arbitration, or if the law requires it. If you lose, you’re on your own which granted is probably still cheaper than a trial. It still should be noted that rejecting the arbitration agreement does not mean you lose the right to arbitration. But by not rejecting it, you definitely lose your right to a jury trial.

In regard to your personal information, Comenity Bank can and will share personal information and you can’t opt out of all of it. For example Comenity uses your personal data for processing transactions, reporting to credit bureaus, offering their own products to you, joint marketing with other financial institutions, and providing affiliates with information about your transactions and experiences. You can’t opt out of any of that.

You can opt out of information being provided to affiliates regarding “information about your creditworthiness” as well as information allowing affiliates and nonaffiliates to market to you. In order to limit your sharing, call 1-800-220-1181 (or 1-877-287-5012, the notice isn’t clear). For Capital One crossovers, you have 30 days until Comenity starts sharing your details. If you cancel your card without opting out, they will still share your info.

Finally the provisions are changing regarding late fees. For most people the late fee on the Playstation Credit Card should be $35. Under Comenity the late fee will be $29 for the first occurrence and then $40 for any subsequent occurrences within six billing periods.

So if you have a Playstation credit card, keep an eye on your mail. You’re going to need to get that rejection letter in in a timely manner otherwise you will lose your right to a jury trial.

Sony’s Digital Refund Offers Crumb Of Refund Rights


Sony’s refund policy just got a fair bit better.

As noted by Push Square, the Playstation terms of service have been updated to note that you can refund a digital purchase within 14 days of purchase assuming that the product has not been downloaded. It also includes a notation making allowances for cases of faulty content.

After purchasing this type of content through PlayStation™Store, you have 14 days from purchase to request a refund to your wallet on PlayStation™Network. If you started to download or stream the purchased content you are not eligible for a refund unless the content is faulty.

In addition, subscription services can be cancelled within 14 days of auto-renewal, with the pro-rated refund depending on how much you have used the service. The money from the refund will go to your Playstation wallet.

Dark Eclipse Launches New Heroes, Free Player Bonuses


Playstation VR’s first MOBA Dark Eclipse has launched a massive content update featuring three new characters and four winter skins. In addition to these updates, Dark Eclipse has also received additional tutorials to get players better acquainted with the controls and strategic elements.

  • Owen – A Leader that can channel his Energy Boost ability to muster strength and
    passively increase his movement speed before unleashing a deadly attack;
  • Sosei – A support Dominator that can sustain lengthy combat and swing the tide of
    battle by reviving fallen Leaders and healing soldiers, knocking back nearby enemy units
    in the process;
  • Jysook – An assassin Dominator with explosive abilities who can lay bomb traps around
    the battlefield and self-destruct to secure crucial kills.

Players who log in to Dark Eclipse will be able to receive daily rewards including eclipse points, player icons, and a leader and hand skin. Today’s update introduces holiday yeti hand skins as well as winter skins for Veronika, Wuntasto, and Jysook.

Dark Eclipse is free to play on Playstation 4 for PSVR and can be found at the official Playstation store.

[Not Massive] Steam Users Are Angry Over Early Tomb Raider Discounts


Shadow of the Tomb Raider is currently on sale and customers aren’t happy.

The third and final installment in the latest Tomb Raider reboot series, Shadow of the Tomb Raider launched on PC on September 14 to pretty favorable reviews and Steam numbers. This week, the game was discounted 34% off on October 16, 47% off for the Croft edition bundle that contains extra DLC. Since the sale began, the game has been bombed by negative reviews citing the game’s sale price. So why the issue?

Normally sales would be a great thing, but early adopters are not happy about Shadow of the Tomb Raider going on such a deep discount a month after launch and not even during a heavy sale period for Steam. More specifically, many of the negative reviews appear to be coming out of China where players are expressing frustration between two major topics: That the game is going on sale so soon after launch and of long wait times to import the game into China adding to the fact that the game is on sale so soon after many received their copies. In short, people feel burned that Square Enix discounted the game so heavily and so quickly after launch.

It seems more than likely that Square Enix is offering this deal because sales from Shadow of the Tomb Raider have been far less than anticipated. Back in September, Eurogamer noted that Shadow’s physical sales in the UK were down 70% from 2013’s Tomb Raider reboot, a more troubling idea considering that Tomb Raider initially launched just on the Xbox and this time around launched on all three major systems (PS4, Xbox One, PC) simultaneously. It also doesn’t help that Shadow cost about $100 million to make. Not a good sign.

Oddly enough, Amazon has the Playstation 4 edition of Shadow of the Tomb Raider on sale for $44.95, a 25% discount, while the Xbox version is only 5% off at $57. I guess we know which version sold better.

We fully expect Square Enix to comment on Shadow’s sales as the company has been pretty forthcoming about its opinions in the past.

H1Z1 Invites PS4 Players To Play A Game of Snipey Shotty


H1Z1 rolls out its latest update this week introducing players to the Arcade mode, limited time events that throw a wrench into the proverbial hornets nest and change the way you play. This week and next week sees the introduction of Shotties and Snipers which is exactly what it sounds like: The only weapons available are shotguns and snipers.

The future of H1Z1 includes new leaderboards for season 2, new weapons for all ranges, and new daily challenges.

Perfect World Announces the Torchlight MMO, Finally


The folks at Runic Games have been talking about a Torchlight MMO since day one, meaning today’s announcement has been more than a decade in the making. Perfect World Entertainment and their new studio Echtra Games today announced that Torchlight Frontiers is in development, an MMOaRPG from the minds that brought us the two Torchlight games that many gamers still hold in high regard.

“Evolving the Torchlight universe into a shared world has always been a goal for the franchise, and I’m excited that we’re finally able to make it a reality,” said Max Schaefer, CEO of Echtra Games. “Torchlight Frontiers will be a living, breathing universe that will still feel uniquely Torchlight, while we add our own creative spin to the game. The team is building something truly special, and we can’t wait for fans to play it for the first time at Gamescom and PAX West.”

Perfect World has described Frontiers as a shared, persistent, dynamically generated world, meaning we may be seeing more of an instanced, hub-like MMO as opposed to one that is 100% open world, ala World of Warcraft. [Video] Remedy Entertainment Unveils Control


Remedy Entertainment and publishing partner 505 Games have announced Control, set for PC and consoles in 2019. Players take on the role of Jesse Faden, director of a secretive agency in New York when the world is invaded by aliens. Players will have to master a variety of powers, loadouts, and reactive environments.

Control represents a new exciting chapter for us, it redefines what a Remedy game is. It shows off our unique ability to build compelling worlds while providing a new player-driven way to experience them,” said Mikael Kasurinen,game director of Control. “A key focus for Remedy has been to provide more agency through gameplay and allow our audience to experience the story of the world at their own pace”

Remedy Entertainment is known for their work on Max Payne, Alan Wake, and Quantum Break.

H1Z1 Strikes 1.5 Million Playstation 4 Systems


H1Z1 has officially hit the Playstation 4 and in the 24 hours since open beta began more than 1.5 million players have downloaded the game to their system.

“This is an incredible milestone and we want to thank all of our player who helped make this possible,” said H1Z1 Producer Terrence Yee. “We believe we’ve found the right balance for battle royale on console and players have responded positively to our reimagining of H1Z1. We will continue to refine the game based on feedback from Open Beta to ensure the best experience possible for our actively growing community.”

Redesigned for the PS4, H1Z1 features more weapons, a reworked user interface, and faster paced gameplay. The open beta can be downloaded for free on Playstation.
