IPE Update: Settlement Negotiations and Sanctions Ahoy!


On the last episode of In Plain English: Trion Worlds was issued a subpoena to produce information regarding the sale of assets to Gamigo, we learned about Golden Gate Games Inc, another entity that may possess some of Trion’s assets and whom the plaintiff intended on serving with deposition paperwork and possibly add as a defendant. The next conference was set for March 15.

Well you can throw that out the window, because it looks like we’ve taken a sharp (and predictable) left hand turn into settlement territory. The March 15 discovery conference and case management conference were both vacated with a 60-day delay to discovery, and a delay in the motion for class certification. Why the sudden cancellations and delays? The parties are seeking settlement negotiations.

“Counsel indicated that they have no pending discovery disputes, and that they jointly stipulate to 60 day stay of discovery, and delay in bringing the motion for class certification, in order to facilitate settlement negotiation.”

This isn’t too surprising, considering 97% of civil cases are settled before they even go to trial. It looks like Aaron Van Fleet’s crew are discussing negotiations with Trion’s insurer because the company’s insurance policy is literally the best remaining asset.

“On March 7, 2019, Plaintiffs’ counsel had preliminary discussion With counsel for Trion’s Directors and Officers Liability insurer. Trion’s Directors and Officers Liability insurance policy appears to be Trion’s most significant remaining asset. The policy is depleted by defense costs. The parties have agreed to explore potential resolution of the matter. Plaintiffs
request sixty-day stay of discovery between the parties (Plaintiffs and Trion Worlds, Inc.), so that the parties may explore potential resolution Without fithher depleting the limited resource potentially available to satisfy the claims of Plaintiffs and the proposed class. Trion agrees that sixty-day stay of discovery is appropriate.”

On the lawsuit side, the plaintiff’s lawyers have still been attempting to serve subpoenas to Golden Gate Games and Gamigo, evidently having no luck in either field.

“Plaintiffs have been unable to serve With subpoenas either Golden Gate Games, Inc. or Gamigo. They have not completed their investigation of whether to add either entity to the case, but do not anticipate doing so at this point. As discussed below, the parties have had preliminary discussion regarding potential resolution of the case. If those efforts are unsuccessful, Plaintiffs will make final determination about adding additional parties in advance of the next Case Management Conference.”

In other news, the plaintiffs are not happy at all with how Trion Worlds has been handing over requested documents, by which I mean how they have been refusing to hand over documents. Trion has allegedly been passing the buck on providing documents related to the illegal lottery, instead pointing to either Gamigo or the Trion shell that the assets were initially transferred over to. Due to Trion’s lack of cooperation, the plaintiffs are giving serious consideration to filing a motion for sanctions for failure to preserve documents despite having filed those requests nearly three years ago. If the sanctions are approved, it would be bad news for Trion and their legal team.

In fact, it seems like Trion Worlds is just in general refusing to cooperate. Trion’s council believes that the documents that the plaintiff have requested may be in the possession of Trion ABC or Gamigo. As for how to get in contact with Gamigo, Trion has so far not provided any information. Virtually every piece of documentation that Trion Worlds objected to was under claims that it was overly broad, vague, and oppressive, or violated attorney-client privilege.

As always, if you want to check out the dockets you can do so at the MMO Fallout Google Drive. If you’re hoping that this lawsuit doesn’t end up in a settlement, I would probably curb your expectations now. Especially with the insurance company taking over negotiations.

Heir of Light Celebrates 1 Year Anniversary


Mobile game developer Com2Us is celebrating the first anniversary of mobile game Heir of Light. In celebration of its birthday, Heir of Light is holding an anniversary event crossover with another Com2Us game: Summoners War. The update includes two Summoners War characters, Valkyrie and Archangel.

The collaboration also includes:

  • 20×20 World Battle – This new game mode allows players to form five teams and battle against five other random teams. Players’ ranks are based on results of each battle and the number of defeated servants.

  • Potential Ability – A new feature that can power up servants in this new update. There are two types of Potential Ability available within this update: Normal and Special. 4-5? Servants can obtain Normal Potential Ability and only 5? Tank Servants can obtain Special Potential Ability.

  • 5? Servant Select Summon Stone – These Summon Stones will act as gifts for players who sign into the game during the event period

Rift’s Progression Server Is Dead, Sunsetting At End of Month


Rift’s progression server experiment is coming to a premature end. As posted on the official forums, Rift’s progression server will come down on March 31 with character transfers occurring the following week.

As part of the sunset, all accounts with a level 50 character on Prime will be receive a level 65 character boost pack as well as one million loyalty points. Unfortunately if you’re at capacity for characters on the live servers, you’re going to have to decide who is getting deleted.

The decision may not surprise Rift players, as one can find multiple threads on the main forum discussing low population on the Rift Prime server.

RuneScape Dumps Bounty Hunter, Redistributes Rewards


The past few months has seen Jagex taking a look at old content and changing it for the better. January saw a massive overhaul to mining & smithing, while this month sees the overhaul of firemaking. Unfortunately, the developer was unable to fix everything.

This week marks the removal of Bounty Hunter, a PvP mini-game that has seen multiple overhauls since its introduction in 2007, but Jagex admits just hasn’t been successful in making fun. Mandrith, the NPC in charge of Bounty Hunter, is taking on a new job of handing out slayer tasks specifically for Wilderness hunting.

Also as part of the update, certain rewards that were specific to Bounty Hunter may now be earned through various other activities in-game. Some items can be crafted, while others must be purchased through various venders. A full list of the reward distribution is available at the link below.

MindArk Talks: Entropia Universe 16th Anniversary


Those of you who keep tabs on the industry will remember that Entropia Universe turns 16 this year, meaning that not only can the game now drive in most states, but it retains its discount card along with the other long-lasting MMOs. As it goes, I had to know what their secret was. Thankfully MindArk was kind enough to let me chat with their CEO Henrik Nel to answer my numerous questions.

MMO Fallout: Entropia Universe launched in 2003, which in the gaming industry is basically three lifetimes ago. What is the secret formula that has kept the game running so long?

Henrik Nel: If we told you it wouldn’t be a secret would it? We are very proud about our real cash economy. Having the game being built around it has created something truly unique which can’t be found anywhere else in the gaming industry. We have achieved a level of trust after 16 years where players can feel confident about their investments being secure and treated with bank level security. It also helps that our community is very mature, entrepreneurial and newcomer friendly.

M: Being free to play, Entropia lacks a barrier to entry. Does Entropia still see a lot of new people peeking their heads in?

H: Yes, we do have a constant stream of players eager to check out the game. Even though some our players started over a decade ago, it is still very possible to start from nothing and
play with them on an even field with some cunning strategies quickly.

M: It seems like growing technology is the biggest threat to older MMOs; with some titles shutting down simply because they have hit their ceiling with new operating systems/hardware. Have you had any major technical hurdles to cross with Entropia now being old enough to get its learner’s permit?

H: In 2009 we made the change from Gamebryo game engine to Cryengine 2. With that change, we had to re-develop a lot of our systems to adapt with the new game engine. As many of the developers are still around from that time, we still possess the knowledge from that transition which will make another upgrade much smoother. We do actually have a graphical improvement just around the corner which utilizes Cryengine, but unfortunately I can’t go into detail about it just yet.

M: How would you most succinctly describe Entropia’s real money economy to someone who only knows it as “that real money MMO”?

H: In Entropia Universe everything has a real-life value since all items has a PED value. PED is our in-game currency which is exchangeable with USD at a 10:1 ratio, so if you loot an item
worth 1000 PED it is worth $100 in the real-world. Your avatar skills can also contain a PED value so everything from your weapon to your acquired skills is worth real USD. Just like in the real world, the actions you make inside Entropia Universe have a real economical consequence.

M: Similarly, I think that for a lot of outsiders, their major experience with Entropia is through these record-breaking land deals. Can you give a brief detail on how land ownership works and how people end up spending tens of thousands of dollars investing in virtual property?

H: Sure, a good example would be the Crystal Palace Space Station which was originally sold in 2009. The player who purchased it at the time got access to four different domes filled with unique creatures only found there. These creatures offer users in Entropia the possibility to loot rare and unique items and in exchange the land owner receives a small tax from the users. The land owner also needs to stay vigilant and listen to the users of their land too as they to possess the ability to alter the look and feel of the area. If done properly, they, just like anybody else in Entropia Universe can withdraw their profits to their real-life bank account.

M: And for a final question in that category, how would you bring in a gamer who is curious but afraid that they will need to put in a substantial investment to get started?

H: Try it out and see for yourself, speak with other players when you are on the inside. There is nothing to stop them from downloading it as it is free to play. We do have Starter Packs for new players which are intended for people that want to start out with a smaller investment, but again it is not a prerequisite to enjoy the game. The Starter Packs are made in such a way that they are extremely helpful for all newcomers. Another important thing is the great society we have inside the game, that as well as the mentor systems really help new players to get a great start and a good way to meet new friends.

M: What kind of content updates does Entropia see these days? Looking at the website there appears to be a steady flow of events for players to participate in.

H: You’re right, we do have a lot of events which is suitable for a lot of different users no matter if you’re a high level or new user. And we have some very interesting content updates coming out this year, with new systems attached. But as Entropia Universe is a Real Cash Economy I can’t go into details on this as it might affect the in-game markets.

M: Has the idea of an Entropia Universe 2.0 ever been tossed around the office?

H: It has been tossed around for sure, and while you should never say never, it is nothing that we are planning to do in the foreseeable future.

M: With many MMOs making the leap to other systems, is the plan to keep Entropia PC-bound?

H: In the future you might very well see more parts of Entropia Universe on other platforms, we already have an Android app connected to our systems, which we have had since 2012. With Virtual Tycoon users can craft and trade while on the move. But currently, we focus a 100% on our PC platform.

MapleStory Retro-Theme Arcade Adventures Live


Nexon’s MapleStory has launched its latest event: Arcade Adventures.

The Retro World Event runs until April 9 and can be enjoyed by players with characters of level 61 and above that will take them to 8-bit pixelated worlds where they can hunt monsters, collect coins, practice their dodging and jumping, avoid traps, and more.

  • Promote the Game!: Players will be able to hunt monsters near their level to retrieve Retro World Promo Coupons and receive coins for a special reward.

  • Eliminate Bug Monsters!: Retro World monsters will begin to appear in Maple World. Players who eliminate the monsters can acquire EXP, mesos and coins.

  • Call of the Goddess: Maplers can learn a special event skill from the ancient Retro World Goddess. As they use this skill, players will be able to earn additional coins after eliminating monsters.

LOTRO/DDO Maintenance Extends Into Day 3


Both Lord of the Rings Online and Dungeons & Dragons Online are entering their third day of maintenance as maintenance on both game’s data centers has hit a bit of a snafu. Both games were taken down for maintenance on March 6, however it became apparent during that maintenance that there were more issues than expected. The completion time has now been extended from its initial 22 hours into its third day.
